Petitioner seeks bail in Balia P.S. Case No.40 of 2016 instituted for the offence under Section(s) 366-A/34 Indian Penal Code.

Counsel for the petitioner submits that the victim has given statement under Section 164 Cr.P.C., wherein, she has not levelled any specific overt act against the petitioner. The victim girl has stated her age to be 19 years although the Court has assessed her age as 15 years.

It is mentioned in para 3 that petitioner has clean antecedents.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.51151 of 2018 (2) dt.25-09-2018 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Balia P.S. Case No.40 of 2016, subject to the condition that both the bailors shall be close relative of the petitioner.
