In his show cause he has taken a stand that it was his first posting after completion of probation period and after going through the order of this Court he got a first impression in his mind that he had to consider the show cause of the petitioner and pass a fresh order at the earliest which he did within a reasonable time. Although this court does not accept the ground taken by the then S.D.O. Danapur but finding that he is a young officer and it was his first posting as S.D.O. at Danapur, this Court is willing to take a lenient view of the matter giving him the benefit of doubt.
