1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Amnour P.S. Case No. 150 of 2024 registered for the offence under Sections 363, 365 of the I.P.C. and later added Section 302, 120(B) & 201 of the I.P.C.
3. As per the prosecution case on 16.05.2024 in the night the informant's son Alok Kumar Singh and his friend Rishabh Kumar came at the shop of the informant, took a bottle of cold drink, left on a motorcycle but till late night the informant's son did not return. During search, the informant went to the house of Rishabh Kumar and asked about his son whereabouts and he was told by Rishabh Kumar that he had dropped the deceased on way and he does not know anything further in this regard. 4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged. He has been made accused on the basis of confessional statement of the co-accused / Rishabh Kumar @ Rishav Kapoor & Satyam Kumar Singh and Rishabh Kumar @ Rishav Kapoor has been granted regular bail.

On the other hand, learned counsel for the informant vehemently opposed the prayer of anticipatory bail and submits that there was dispute between the petitioner and the deceased regarding misbehaviour by the deceased with his girlfriend for which the petitioner hatched a conspiracy, organized a party and the co-accused was told to bring the deceased along with him. When the deceased was brought near the orchard under conspiracy of the petitioner the other co-accused Abhay Tiwari and Maahi Singh strangulated the informant's son with the help of towel due to which he died. The entire story has been narrated in the confessional statement of the co-accused. Learned counsel next submits that the main conspirator in this case is Chintu (petitioner) with whose girlfriend the deceased had allegedly misbehaved and in order to take revenge the petitioner killed the informant's son along with others.

Having regard to the submission made by the parties, taking into consideration the nature of allegation and the fact that statement made in the confessional statement may lead to further investigation by the Police for which custodial interrogation of the petitioner may be necessary, I am not inclined to grant anticipatory bail to the petitioner. The prayer for the same is rejected.
