2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 399, 402 of the Indian Penal Code and 25(1-b)a/26, 35 of the Arms Act and 8/8 C/21 (b)/ 20(b) (ii) (c) of the NDPS Act.
3. The case of the prosecution is that from the possession of the petitioner namely, Samsuddin Nadaf one lathi in his right hand and one Redmi mobile was recovered from his pocket.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that all the cases were lodges after this case and was remanded after this. It is next submitted that from the FIR, it is clear that only
Patna High Court CR. MISC. No.72522 of 2024(5) dt.20-01-2025 2/2 lathi and mobile have been recovered from the possession of this petitioner. It is further submitted that the petitioner is languishing in judicial custody since 19.06.2024
5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner has got criminal antecedent of four cases.
6.Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bajpatti P.S. Case No. 168 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Act, Sitamarhi/Competent Jurisdiction.
