The petitioners seek regular bail in connection with Beldaur P.S. Case No. 15 of 2017 for the offence punishable under Sections 363, 365, 511/34 of the Indian Penal Code. The case of the prosecution in short is that the accused persons i.e. the petitioners herein had attempted to kidnap the informant for the purposes of solemnizing his marriage according to their wishes, however, on alarm being raised, various people had come there and the petitioners managed to flee away.

The learned counsel for the petitioners has submitted

No.63999 of 2019(2) dt.10-01-2020 2/2 that the petitioners have been falsely implicated in the present case, no offence is made out against them and the matter has also been compromised in between the parties. It is further submitted that that as far as the petitioner no.1 is concerned, one case is pending against him in which he is on bail and as far as petitioner no.2 is concerned, he is having a clean antecedent. Lastly, it is submitted that the petitioners are languishing in custody since 04.07.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners as also considering the period of incarceration of the petitioners, I deem it fit and proper to direct for release of the petitioners on regular bail.

Accordingly, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria in connection with Beldar P.S.
