2. The petitioner seeks regular bail in a case registered for the offences punishable under Sections 8(c) read with Section 21(C)/25 and 29 of the Narcotic Drugs & Psychotropic Substances Act, 1985.

3. As per prosecution case, the N.C.B., Patna Unit, on the basis of secret information, raided the rented house of Sunny Kumar and recovered 710 grams of morphine, one countrymade pistol, one country-made katta, four live cartridges, a digital weighing balance and other articles used for packing small packets, along with the key of a motorcycle and the motorcycle allegedly used for selling morphine packets.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 04.06.2021 and till date the trial has not been concluded. Similarly situated co-accused Munna Ravidas @ Munna Kumar has already been granted bail by this Court vide order dated 12.09.2025 passed in Cr. Misc. No. 50369 of 2025.

5. Learned A.P.P. for the State vehemently opposed the prayer for bail and submitted that petitioner is having one criminal history being Ram Krishna Nagar P.S. Case No. 205/2021.

6. Considering the aforesaid facts and circumstances, period of custody and the tardy progress of trial, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, NDPS Act, Court No. 1, Patna in connection with Special Case No. 53 of 2021, arising out of F.No. NCB/PZU/V/12/2021.
