1. Heard Mr. Rajesh Kumar learned counsel for the petitioner and Mr. Dilip Kumar No. 1, learned APP for the State.

2. The petitioner seeks regular bail in connection with Dholbajja P. S. Case No. 46 of 2025, dated 28.05.2025, registered for the offences punishable under Sections 96 and 3(5) of the B.N.S, 2023.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is 19 year old boy, has been languishing in jail since 03.07.2025, the informant's daughter who is said to be victim has recorded her statement before the Judicial Magistrate in which she revealed her friendship with this petitioner and further revealed that she solemnized marriage with this petitioner according to her own will though,

Patna High Court CR. MISC. No.67625 of 2025(3) dt.10-12-2025 2/2 as per the victim's statement on account of persuasion by the petitioner, the victim left her parent's house but except this there is no allegation against the petitioner. It is lastly submitted that the petitioner has suffered a lot and during the investigation, the victim's age was determined as 17 years and one month on the basis of verification from the victim's school records.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Heard both the sides and perused the FIR and case diary of this case. Though, the instant matters relates to the serious offences, however, considering the petitioner's young age and mainly completion of investigation and his custody period, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Dholbajja P. S. Case No. 46 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
