JUSTICE SANJAY PRIYA ORAL ORDER 09-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Pothia P.S. Case No. 180 of 2017 instituted for the offence under Sections 406, 409, 471, 472, 467, 468, 420 and 120(B) of the Indian Penal Code.

In the written report, it is alleged that one private person namely Sanjay Rai made complaint on his information received from RTI letter No. 21/12 dated 11.01.2012. The Collector, Kishanganj, took cognizance of the matter and the matter was enquired. The V.C. of Lalit Narayan Mishra Institute of Economic Development & Social Change gave report in the year 2013 that the certificate is genuine, but after three years, again, another report was called for by the Collector, and in that

Patna High Court Cr.Misc. No.63018 of 2017 (2) dt.09-01-2018 2/3 report, the another V.C. namely, Shivdeo Singh of the said institute, found all the entries on the certificate of the petitioner incorrect.

It has been submitted that petitioner was selected as Programme Officer by Rural Development Department, Government of Bihar, Patna, through written test conducted online. He has joined as Programme Officer on 6.9.2010 in the office of Deputy Development Commissioner, Kishanganj, by submitting his testimonials and certificates. It has further been submitted that it is a matter of enquiry and no criminal offence is made out. The petitioner was appointed in the year 2010 and at present he has already been removed from service on the basis of aforesaid allegation.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Pothia P.S. Case No. 180 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Kishanganj, subject to the conditions as laid down under Section 438 (2) Cr. P.C. with further conditions

(1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court and his absence on two consecutive dates without proper and reasonable reason will be liable to cancel his bail bond and (3) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
