2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 117(2), 76, 109, 303(2), 351(2), 352 and 3(5) of the B.N.S.
3. The case of the prosecution is that the petitioner assaulted with iron rod on the head of the informant.
4. Learned counsel for the petitioner has submitted that from perusal of the order of the learned trial court it is clear that the trial court has recorded that the injury report is attached with the record and the Doctor has found three lacerated injuries and three bruise injuries over the injured person. Learned counsel for the petitioner has submitted that all the injuries are found to be simple in nature. Learned counsel for the petitioner
Patna High Court CR. MISC. No.68123 of 2025(2) dt.24-09-2025 2/2 has submitted that actually the husband and wife had the scuffle but due to enmity this petitioner has been framed in this case. Learned counsel has lastly submitted that the petitioner is languishing in judicial custody since 01.04.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bhagwanpur (Teyai) P.S. Case No. 84 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Begusarai.
