This is the second attempt of the petitioner to seek bail as earlier his bail application was rejected vide order dated 09.03.2022 in Cr. Misc. No. 58946 of 2021 on the ground that petitioner is husband and dead body of the wife was recovered from the house and as such presumption was against him. Since the petitioner is husband of the deceased and it has been submitted that the trial is going and two witnesses have been examined, as such the Court is not inclined to released the petitioner on bail.
His prayer for bail is thus rejected.
However, in the event if the trial is not concluded
Patna High Court CR. MISC. No.68702 of 2022(2) dt.07-12-2022 2/2 within a period of nine months from the date of receipt/production of a copy of this order, the petitioner would be at liberty to file an application seeking regular bail before the learned trial court itself and if the learned trial court comes to a conclusion that for no fault of the petitioner, the trial was delayed, then the learned trial court shall pass orders in accordance with law and if the application is rejected, the same should be by a reasoned order.
