The petitioner, in the present case, is seeking regular bail in connection with Ghorasahan (Jharokhar) P.S. Case No. 73/2017, registered for offences alleged under Sections 302, 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a Pattidar of the deceased, he has been falsely implicated in this case because of the family dispute. It is submitted that there is no evidence at all to substantiate the allegations against the petitioner who has been named along with six other persons in the F.I.R. It is further submitted that the co-
Patna High Court Cr.Misc. No.52452 of 2018 (2) dt.28-09-2018 accused Mishrilal Sah has been granted bail by a learned coordinate Bench of this Court in Cr.Misc.No.36652 of 2017. It is further submitted that the other co-accused persons save and except one Sanjay Sah have been granted regular bail by this Court. It is further submitted that the name of the petitioner is said to have also transpired in the confessional statement of co-accused Dinesh Prasad Gupta, he has also been granted bail by a learned coordinate Bench of this Court.
No one has appeared on behalf of the State to oppose the application.
Considering the facts and circumstances of the case where similarly situated accused have been granted privilege of regular bail, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge, East Champaran at Motihari in connection with Ghorasahan (Jharokhar) P.S.
