JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2019 Petitioner seeks regular bail in connection with Vaishali P. S. Case No. 81 of 2018, registered for the offences punishable under Sections 147, 148, 149, 323, 307 and 302 of IPC. As per F.I.R. 12 accused persons including the petitioners have assaulted the father of the informant, causing serious injury and he scummed injuries.

Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against them. They are in custody for about 10 months and they are ready to abide by any condition imposed upon them. Further submission is that some of the accused persons have been granted bail by a Co-ordinate Bench of this Court, vide order dated 02.08.2019 passed in Criminal Misc. No. 51510 of 2019. Further submission is that petitioners are aged about 70 years and 65 years old, respectively.

No.68400 of 2019(2) dt.27-11-2019 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that there are nine injuries found on the person of the deceased and prayer for bail of one of the accused was rejected by a Co-ordinate Bench of this Court.

Having heard both sides, in view of the facts and circumstances, as stated above, especially, the age of the petitioners as well as general and omnibus allegation against them, let the petitioners above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of Hena Mustaffa learned Judicial Magistrate, 1st Class, Vaishali at Hajipur, in connection with Vaishali P. S. Case No. 81 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to co-operate in disposal of the trial and appear before the court below as and when required.
