The petitioner seeks bail in connection with Aurai P.S. Case No. 20 of 2017, registered under Sections 363 and 366A of the Indian Penal Code.

The accusation is that when the informant woke up in the early morning on 09.02.2017, he found his daughter missing in the house, who was student of matric.

Submission is that it would appear from the first information report that the daughter of the informant, who is said to be aged about 17 years, left the parental house according to her sweat will. In course of investigation, the daughter of the informant was recovered from the house of the petitioner, but, she did not make any complaint about misbehaviour or physical relation by the petitioner with her. In fact, due to love affairs,

No.68977 of 2019(3) dt.18-02-2020 2/2 the daughter of the informant left her parental house and performed the marriage with this petitioner, but, in course of investigation, the victim-daughter of the informant was apprehended by the police from the house of the petitioner. For proof of marriage both sworn an affidavit before the Public Notary on 23.06.2017.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Aurai P.S. Case No. 20 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate-cum-Sub Judge, XIV, Muzaffarpur. (Rajendra Kumar Mishra, J) Shamshad/- U T
