The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 342, 323, 307, 356, 504, 506, 34 of the Indian Penal Code. As per prosecution case, informant alleged that while he was going to attend his tuition class, petitioner along with coaccused intercepted and assaulted him by butt of the pistol and also snatched cash of Rs. 15,000/-.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on the basis of suspicion. Nothing incriminating articles have been recovered from the conscious possession of this petitioner. It is further
Patna High Court CR. MISC. No.68322 of 2022(2) dt.22-03-2023 2/2 submitted that there is no grievous injury of informant so Section 307 does not attract and rest of the Sections are bailable. It is further submitted that the petitioner is languishing in judicial custody since 26.04.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody of thie petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jakkanpur P.S. Case No. 412 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Patna.
