JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

Although, it is said that petitioner was arrested from the house in which in huge quantity liquor was recovered but admittedly, the aforesaid house belonged to FIR named accused Sunil Kumar Singh.

Submission on behalf of the petitioner is that he does not have any concern with the seized liquor nor with the aforesaid Sunil Kumar Singh. Furthermore, it is submitted that petitioner does not have any criminal antecedent and is

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge (Excise), Buxar in connection with Excise G.R. No. 638 of 2019 arising out of Buxar P.S. Case No. 530 of 2019.
