The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 379, 411/34 of the IPC, Section 4/2022 MM(DR) Act, 11/43 of BM (CPIMTS) Rule, 2019 and Section 56 of BM (CPIMTS) Rule, 2021.

The prosecution case, in brief, is that while the police party were on patrolling duty, they apprehended the petitioner along with a motorcycle bearing Registration No. BR-27D0999. The petitioner disclosed the names of co-accused persons who were also involved in Bhabhag-Bhag group. It is further alleged that they used to pass sand illegally by vehicles.

He has falsely been implicated in this case. The petitioner has no concern with the so-called bhagam-bhag group or with the seized motorcycle and he has never involved in illegal sand business. It is further submitted that no illegal mines and mineral were seized from the possession of the petitioner. Moreover, petitioner is languishing in judicial custody since 22.9.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sheikhopur-Sarai P.S. Case No. 155 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura.
