The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304(B),120(B),34 of the Indian Penal Code.

The victim of dowry death was married with coaccused Jitendra Kumar. Petitioners are relatives of Jitendra Kumar. Jitendra Kumar is already in custody. There is allegation of demand of dowry and torture of victim. Another case on kidnapping of the another daughter of the informant was lodged. The victim of kidnapping was recovered and her statement under Section 164 Cr.P.C. was recorded, wherein, she

Patna High Court Cr.Misc. No.51850 of 2018(2) dt.09-10-2018 2/2 specifically stated that she had voluntarily gone along with petitioner Bishwajeet Kumar who is devar of the deceased. Learned counsel for the informant opposes the prayer of anticipatory bail.

Considering the general and omnibus allegation and the background of allegation as well as statement of the sister of the victim, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Ram Krishna Nagar P.S. Case No. 189 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
