The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 724 of 2022 arising out of Nowkothi P.S. Case No. 102 of 2021 dated 23.07.2021 registered for the offences punishable under Sections 302, 120B read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, all the six F.I.R. named accused persons holding pistols came to the husband of the

Patna High Court CR. MISC. No.68598 of 2022(2) dt.12-04-2023 2/3 informant and they started abusing him on account of nonpayment of rangdari and they also began to fire indiscriminately on the husband of the informant and due to which he died on the spot.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No such occurrence as alleged has ever taken place. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused Saurav Kumar. Learned counsel has further submitted that the co-accused person has already been granted bail by Co-ordinate Bench of this Court vide order dated 22.08.2022 passed in Cr. Misc. No. 68584 of 2021. The petitioner has got clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 03.03.2022.

Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
