The petitioner apprehends his arrest in connection with Alamganj P.S. Case No.234 of 2018 registered under Sections 147, 467, 468, 420, 406, 341, 323, 504 and 379/34 of the Indian Penal Code.

The accusation is that plot no. 1374 situated at Pyare Lal Ki Bgh near Shitla Mandir, is in the name of Sumitra Devi @ Bijli Devi, mother of complainant, Vijay Kumar Pandey and the revenue rent receipt is being issued in favour of his mother, Sumitra Devi but with intention to grab the said land, petitioner executed the sale deed of some portion of Plot No. 1374 in favour of Manisha Devi and her husband Arbind Yadav.

Patna High Court Cr.Misc. No.55001 of 2018(2) dt.11-12-2018 2/2 Learned counsel for the petitioner submits that, in fact, 10 decimals of land of plot no. 1374 was purchased in the name of Ram Raj Sahkari Grih Nirman Limited, of which, petitioner is the Secretary and on 13.11.1984, petitioner being Secretary of Ram Raj Sahkari Grih Nirman Limited executed the sale deed in favour of Smt. Sanjeeta Singh as alleged in the F.I.R. but with ulterior motive the present case has been lodged with false allegation.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-I, Patna City, Patna, in connection with Alamganj P.S. Case No.234 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
