ANJANA MISHRA ORAL ORDER 14-08-2018 A supplementary affidavit has been filed today stating that the petitioner no. 1, namely, Md. Mannan @ Md. Abdul Mannan, Son of Late Md. Safique has since been expired while in custody on the night of 12th of August, 2018. Accordingly, the application as against petitioner no. 1, namely, Md. Mannan @ Md. Abdul Mannan, has become infructuous.
Let the supplementary affidavit filed today be kept on record.
In view of the above, the application, as against petitioner no. 1, namely, Md. Mannan @ Md.
Abdul Mannan, is dismissed as infructuous.
Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are in custody since 25.06.2018 in connection with Bakhtiarpur P.S. Case No. 258 of 2018 for the offence registered under Sections 147, 148, 149, 341, 323, 307, 302, 384, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioner nos. 2 to 4 are family members of the accused persons named at serial no. 1 to 4 and in the entire first information report no overt act has been attributed to the present petitioners, who are female members. It is further submitted that petitioner nos. 2 to 4 have been languishing in jail since 25.06.2018 and have no criminal antecedents.
Considering the aforesaid facts and circumstances of the case, let the petitioner nos. 2 to 4 namely, Bibi Khushubu @ Chandi Sultana @ Chandi Sultan @ Chandni, Naaj Parbin @ Bibi Naaj and Bibi Ruksana be released on bail on furnishing bail bond
of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur P.S. Case No. 258 of 2018.
