The petitioner seeks bail in a case registered under Sections 3, 4 & 5 of Immoral Traffic (Prevention) Act, 1956 and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case, in short, is that two persons were found taking liquor in the resort.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 03-08-2019. It is alleged that two other co-accused are said to have been taking liquor in the resort in question. The petitioner was also there in the said resort. He had nothing to do with the Immoral Traffic

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Punpun P.S. Case No. 205 of 2019.
