Mr.Suresh Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-10-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

Allegation is 8-10 unknown accused persons entered into the office of the informant, broke the steel almirah, threw away the articles and took away mobile sets of the informant and his labourers.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.8.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused.

Patna High Court CR. MISC. No.64540 of 2019(2) dt.22-10-2019 2/2 There is no recovery of any incriminating article from the petitioner. The petitioner has not been put on T.I.P. Other coaccused has been granted bail vide Annexure 2 to the present application.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Miss Simmi Kujur, learned Judicial Magistrate, 1st class, Khagaria in connection with Gogri P.S. case No.217 of 2016.
