JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Manjhi Case No. 112 of 2019, registered for the offences punishable under Sections 341, 323, 504, 307/34 of the Indian Penal Code.

As per F.I.R there is allegation against the petitioners that they asked the informant to remove the cow dung thereafter they assaulted the informant causing injuries. Submission of the learned counsel for the petitioners is that the allegations are false and concocted, as a matter of

No.68920 of 2019(2) dt.18-11-2019 2/2 fact, there was marriage of the co-accused on that date and for that they have requested to informant to remove the cow dung due to which there was scuffle took place between the parties and injuries of two persons are simple in nature about one opinion was kept reserved but nothing specific has been attributed against any of them.

Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned ACJMII, Saran at Chapra or to satisfaction of his learned successor judge in connection with Manjhi P.S. Case No.-112 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
