The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 366(A) & 34 of the Indian Penal Code. As per allegation in the FIR, daughter of the informant went to shop but did not return. On search informant came to know that victim girl was lastly seen with the petitioner. It is further alleged that when the informant went to petitioner's house, family members of the petitioner started to abuse and threat him. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Not a single witness has supported the prosecution story. This case is based on circumstantial witness. There is delay of five days in lodging the FIR without any plausible explanation. Victim was in talking term with the petitioner for the last two years.
Patna High Court CR. MISC. No.69524 of 2022(3) dt.11-04-2023 2/2 Statement of the victim girl was recorded u/s 164 Cr.P.C. in which she has stated that petitioner took the victim girl to Hyderabad and after 4-5 days petitioner took her to his relative's house and from there on her insisting, he brought her back to Ramgarh. She has not made any allegation of physical abuse against the petitioner. Petitioner has no criminal antecedent and he is languishing in judicial custody since 29.06.2022.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st, Mohania, Kaimur at Bhabua in connection with Ramgarh P.S. Case No. 204 of 2022.
