JUSTICE ARUN KUMAR ORAL ORDER 12-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Phulparas PS Case No. 242 of 2017 registered under Sections 448, 147, 148, 149, 307, 302, 120(B) of the IPC and Sections 27, 15(1-b)a, 26 and 35 of the Arms Act.

The allegation in brief is that Pramod Yadav shot at the informant's nephew causing his death and when another family members came to his rescue then the accused persons shot at them causing fire arm injury; in the meanwhile one of the accused Vinod Mandal also died there and it is alleged that this petitioner who was a married lady of that village; one Rajiv Prasad Singh accused had kidnapped her and she is living with him as second wife. Learned Counsel for the petitioner submits tat the petitioner is not named in the FIR, specific allegation is against the FIR named accused persons for killing the deceased and she has been made accused only for being wife of named accused Rajiv Prasad Singh. The petitioner has clean antecedent and is in custody since 30.9.2017.

Having considered the said facts and circumstances, the

Patna High Court Cr.Misc. No.1374 of 2018 (3) dt.12-02-2018 petitioner, namely, Guriya Devi @ Shashi Prabha is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM II Jhanjharpur (Madhubani) in connection with Phulparas PS Case No. 242 of 2017.
