Petitioner along with Ashutosh Anand @ Sonu and Saurabh Suman looted Bolero Jeep of the informant which, unfortunately, slipped in a ditch after covering some distance whereupon, was located by the police including apprehension of the petitioner and others while taking out the jeep through tractor. Petitioner has got criminal antecedent as per para-3 of the petition. Learned counsel for the petitioner has submitted that nothing was recovered from his exclusive possession. Also submitted that he happens to be under custody since 02.05.2018. Also submitted that other co-accused who were apprehended along with petitioner, namely, Lakshman Paswan as well as Kailash Kumar have already been released on bail.

Patna High Court Cr.Misc. No.52566 of 2018 (2) dt.04-09-2018 Learned APP opposed the prayer for bail.

Prayer for bail is rejected. However, the learned lower court will release the petitioner on bail after examination of informant on its own satisfaction.
