JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-01-2024 The present modification application has been filed for modification of the order dated 31.08.2023 passed in Cr. Misc. No.54385/2023 to the extent of correcting the father's name of the petitioner no.1 and also to extend his period to surrender. 2.

It is submitted by learned counsel for the petitioner that in the aforesaid order, the father's name of the petitioner no.1 has been wrongly mentioned as 'Kadam Sada' in place of 'Kadam Sada @ Tanuk Lal Sada'. The correct name is mentioned in the prayer portion of the modification application and the fresh Vakalatnama filed by the petitioner no.1. 3.

Considering the submission of learned counsel for the

Patna High Court CR. MISC. No.76408 of 2023(3) dt.12-01-2024 2/2 petitioner, the order dated 31.08.2023 passed in Cr. Misc. No.54385/2023 is modified to the extent that in the order-sheet at cause-title portion, the father's name of the petitioner no.1 be read as "Kadam Sada @ Tanuk Lal Sada".

Office is directed to correct the father's name of the petitioner no.1 in the cause-title portion.

Further, in the interest of justice, the period to surrender of the petitioner no.1 is extended by two weeks from today in connection with Narpatganj P.S. Case No.643 of 2018, pending in the court of learned Chief Judicial Magistate, Araria, subject to deposit of Rs.2000/- (Rs. Two Thousand) in the Victim Compensation Fund, Bihar..

The order dated 31.08.2023 passed in Cr. Misc. No.54385/2023 is modified to the extent as indicated above. Let this order be read along with the order dated 31.08.2023. 7.

Accordingly, this modification application stands disposed of.
