JUSTICE SANJAY PRIYA ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Choutarawa (Bathawariya) P.S. Case No. 324 of 2013 instituted for the offence under Sections 147, 148, 149, 353, 386, 307, 414 of the Indian Penal Code and Section 27 of the Arms Act. In the written report it is alleged that Hoshila Yadav and Hakim Ansari were arrested on the spot. They disclosed the name of the petitioner along with other accused persons. Counsel for the petitioner submits that petitioner was not apprehended on the spot. Counsel for the petitioner further submits that Hoshila Yadav and Hakim Ansari with similar allegation have been granted bail by a coordinate Bench of this Court vide order dated 07.05.2014 passed in Cr. Misc. 11312 of

Patna High Court Cr.Misc. No.56552 of 2018 (3) dt.09-10-2018 2/2 2014.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Bagaha, West Champaran, in connection with Choutarawa (Bathawariya) P.S.
