Petitioner seeks bail in Fulwaria P.S. Case No.128 of 2017 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. There is no recovery from his possession. No Test Identification Parade has been held. His name has come in the confessional statement of Rohit Kumar. Rohit Kumar has already been enlarged on bail by a Bench of this Court by order dated 19.07.2017 passed in Cr. Misc. No.31615 of 2018. Petitioner is said to be in custody since 13.06.2018

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Fulwaria P.S. Case No.128 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
