Learned counsel submits that the petitioner is getting scale of untrained whereas the petitioner is B.Ed. and entitled to B.A. trained scale with effect from 16.12.2012. The claim of the petitioner requires factual enquiry and the District Programme Officer (Establishment), Supaul is

Patna High Court CWJC No.19645 of 2019(2) dt.25-09-2019 2/2 competent to examine the record and ascertain whether the petitioner is entitled to B.A. trained scale with effect from 16.12.2012 and if the petitioner is graduate trained and similarly circumstanced others have been granted the benefit of trained scale from the date of passing training examination, there is no reason adopting different yardsticks so far as the petitioner is concerned.

Accordingly, the writ petition is disposed of with a direction to the District Programme Officer (Establishment), Supaul to examine the claim of the petitioner for grant of graduate trained scale with effect from 16.12.2012 or other dates which is admissible in accordance with law and grant all consequential benefits within the time indicated hereinabove. With the aforesaid, the writ application stands disposed of.
