The petitioner seeks bail in connection with Sarai P.S. Case No. 129 of 2018 dated 22.06.2018 instituted for the offences under Sections 366A/34 of the Indian Penal Code.

The petitioner is said to have abducted/kidnapped the sister of the informant, who according to him, was of a minor age.

Learned counsel for the petitioner has drawn the attention of this Court to the 164 statement of the victim girl who has stated that she is about 17 years and few months old and she has married the petitioner of her own volition. She has further clarified that she wishes to stay with the petitioner as his legally wedded wife.

The petitioner is in custody since 27.06.2018. Regard being had to the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. Case No. 129 of 2018.

It is however made clear that the grant of bail to the petitioner does not amount to any imprimatur on the validity of the marriage of the petitioner with the victim.
