2. The petitioner has prayed for bail in connection with Yogapatti P.S. Case No. 206 of 2024 registered for the offence punishable under Sections 306, 201, 120(B)/34 of the Indian Penal Code.
3. The case of the prosecution is that the police has got an information that a lady has committed suicide after the quarrel with the relatives and her dead body is concealed in the house. The police visited the house and recovered the dead body. In the last part of the FIR, there is name of five persons.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.69939 of 2025(2) dt.08-10-2025 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the name of this petitioner was not there in the FIR. Petitioner is brother-in-law of the deceased. During the course of investigation petitioner's name has surfaced. The learned counsel for the petitioner has also submitted that there is no eye-witness to the said occurrence. The nature of allegation is general and omnibus. It has also been submitted that similarly situated other co-accused persons have already been granted bail by learned co-ordinate Bench of this Court in Cr. Misc. Nos. 26351 of 2025 and 82701 of 2024. The case of this petitioner stands on similar footing. He further submits that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 22.06.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
