The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

560 Kilograms of Mahua flower was recovered from the pickup van of the petitioner. The petitioner has got no criminal antecedent.

Submission is that the recovered flower was to be used for feeding the cattle.

Considering the lack of sufficient material against the petitioner to support the offence alleged, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the

Patna High Court CR. MISC. No.71340 of 2019(3) dt.09-12-2019 2/2 learned Court-below where the case is pending in connection with Sherghati (Dobhi) P.S. Case No.397 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
