The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 338, 307, 353 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act. There is recovery of 80 litres of illicit country made liquor from the bank of river Banas, situated in village Chirapur. On seeing the police party several persons started to escape but on chase eight persons were apprehended who disclosed the name of petitioners, as one of their associates. It is submitted by learned counsel for the petitioners that petitioners were not apprehended from the spot. Nothing

Patna High Court CR. MISC. No.68660 of 2022(2) dt.16-12-2022 2/2 has been recovered from the conscious possession of the petitioners. The petitioner has no concern either with the place of recovery or the seized illicit liquor. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court I, Bhojpur, Ara in connection with Aayar P.S Case No. 69 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
