The petitioner is in custody in connection with Triveniganj PS Case No. 214 of 2018 for the offence under Section 363/366A/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case, statement has been made by the victim under Section 164, CrPC. From perusal of the statement made under Section 164, CrPC it appears that the court has assessed the age of the victim as 18 years whereas the victim has claimed that she is 20 years old. From the statement it appears that the victim was not ready to agree for a wedlock with the person with whom her parents had fixed the marriage. The victim was in love with the present

No.54923 of 2018(2) dt.28-09-2018 2/2 petitioner who is brother-in-law of her brother and voluntarily left the house on 19.05.2018 and solemnized marriage with the petitioner at Janakpur Dham Temple. From her statement it is evident that she is ready to live with her husband, namely, Anirudh Mandal, who is the petitioner in this case. Considering the aforesaid fact, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Supaul in connection with Tribeniganj PS Case No.214 of 2018.
