Petitioner is in custody in connection with Kanhauli P.S. Case No.72 of 2018 for the offence under sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

Learned counsel submits that the alleged liquor was recovered from the Maruti Car and not from the conscious possession of the petitioner.

The petitioner is in custody since 15.6.2018. Considering the aforesaid fact that nothing was recovered from the conscious possession of the petitioner and
