JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 27-02-2025 Heard Mr. Raju Kumar Singh, learned counsel for the petitioner and Mr. Dilip Kumar No.1, learned APP for the State assisted by Mr. Surj Bansh Roy, learned counsel for the informant.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 323, 336, 337, 338, 326, 307, 302, 504 and 506 of the Indian Penal Code.
3. The petitioner along with other co-accused persons are said to have fired upon the son of the informant due to which he died.
4. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case
Patna High Court CR. MISC. No.83662 of 2024(3) dt.27-02-2025 2/2 due to previous enmity. There is no eye witness of the said occurrence. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecedent and has been languishing in custody since 31.07.2024 but in the impugned order it is stated that petitioner has two criminal antecedents.
5. Learned APP for the State assisted by learned counsel for the informant vehemently opposing the bail petition submitted that there is direct allegation against the petitioner of resorting firing due to which the son of the informant died and the same has also come in para-65 of the case diary.
6. In the facts and circumstances of the case and the allegation levelled against the petitioner, I am not inclined to enlarge him on bail. The prayer for bail is hereby rejected at present.
