JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of S. Tr. No. 862 of 2011 arising out of Isuapur P.S. Case No. 61/2007, disclosing offences under Sections 366(A) and 34 of the Indian Penal Code.
Allegation against the petitioner and others is of kidnapping the minor daughter of the informant. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and other accused persons after full trial have been acquitted in this case and as the petitioner was not aware about the same, he could not appear before the court below earlier.

Having heard both sides, considering the facts and circumstances and also the fact that petitioner has been
Patna High Court CR. MISC. No.64525 of 2019(2) dt.15-10-2019 2/2 absconding since long, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
This application is, accordingly, dismissed.
