The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392, 411 of the Indian Penal Code.

The prosecution case, in brief, is that informant was going to his home, three miscreants boarded on a motorcycle attacked him and assaulted him thereafter, snatched his mobile phone and tried to flee away. The petitioner with the help of villagers, caught the accused persons and handed over to the police.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to ulterior motive.

No.71932 of 2022(2) dt.02-03-2023 2/2 Nothing incriminating article has been recovered from the conscious possession of the petitioner and in respect of the alleged recovery of motorcycle bearing registration no. BR06N8480, the same belongs to the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 22.9.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kanti P.S. Case No. 647 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Muzaffarpur.
