JUSTICE ARUN KUMAR ORAL ORDER 22-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sikarhata PS Case No. 47 of 2017 registered under Section 366A of the IPC. The allegation in brief is that the informant's daughter became traces from the house in the night and suspicion is raised that one Rupak Kumar had enticed her away, on recovery she stated that she was kidnapped by Rupak and others including the petitioner and this petitioner had committed rape.
Learned Counsel for the petitioner submits that it was a case of elopement with Rupak, the petitioner was also made accused in this case, though the allegation is of committing rape in the captivity but not supported by the medical evidence, the girl has been found to be major and Rupak has been admitted to bail by a coordinate Bench of this Court.
Having considered the said facts and circumstances, the petitioner, namely, Mahmud Mansuri is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Bhojpur at Ara in connection with Sikarhata PS Case No. 47 of 2017.
