The sole petitioner, apprehending her arrest in connection with Sarairanjan P.S. Case No. 47 of 2018, registered for the offence under Sections 323/34, 354, 366-A, 368, 370, 372, 504, 506 and 120-B of the Indian Penal Code , 1860 , has prayed for grant of bail in the event of her arrest or surrender.
Learned counsel for the petitioner tried to persuade the Court that case was initially initiated on the basis of complaint petition in which no specific accusation was made against the petitioner, however, subsequently petitioner was
Patna High Court Cr.Misc. No.53786 of 2018(2) dt.10-09-2018 2/2 arrayed as accused as if victim in her statement recorded under Section 164 of the Code of Criminal Procedure, 1973 ( hereinafter referred to as the "Cr.P.C."), has named the petitioner.
Be that as it may, considering the nature of accusation as well as the fact that victim has disclosed about the complicity of the petitioner in her statement under Section 164 of the Cr.P.C., there is no reason to entertain the prayer for grant of anticipatory bail.
The petition stands dismissed.
