JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioners seek bail in anticipation of their arrest in connection with Tisiauta P.S. Case No. 43 of 2019 registered for the offences punishable under Sections 304B and 201 of the Indian Penal Code.
Petitioners happen to be mother-in-law and father-inlaw of the deceased and allegation is that they caused the death of the deceased due to torture meted out to her with respect to demand.
Submission of learned counsel for the petitioners is that there is no specific allegation attributed against them, rather deceased suffered from chest pain and she was taken to hospital where she died and in support of the contention prescription
Patna High Court CR. MISC. No.68583 of 2019(2) dt.25-10-2019 2/2 with respect to deceased has been annexed to the petition and son of the petitioners has also given information about her death to her family members and husband of deceased is in custody. Heard learned APP also.
In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Tisiauta P.S. Case No. 43 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
