The petitioner is apprehending her arrest in a case registered under Section 7 of Essential Commodities Act. The prosecution case, in brief, is that some empty drums and a drum filled with a little K. Oil are alleged to have been seized from Geeta General Store and it is stated that the said Geeta General Store belonged to the petitioner.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in this case. The allegation made in the FIR is denied by the petitioner. The petitioner is ready to deposit Rs. 25,000/ in the court below subject
Patna High Court Cr.Misc. No.53163 of 2018 (2) dt.20-09-2018 to final outcome of the case.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, if the petitioner deposits the said amount of Rs. 25,000/- in the court below subject to final outcome of the case, within six weeks from the date of receipt of the order, she shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 237 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
