Petitioner is in custody in connection with Kotwali (Tilkamanjhi) P.S. Case No. 527 of 2017 for the offence under section 395 of the Indian Penal Code and subsequently added section 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since11.4.2018 but he was not put on TIP. The case was registered against unknown. In case, against unknown, the prosecution is under obligation to hold TIP to ascertain whether the petitioner was real person who has committed the crime.

Case No. 527 of 2017, S.T. Case No. 476 of 2018.
