The petitioners seek bail in connection with Mahindwara P.S. Case No. 107 of 2019, registered for the offence punishable under Section 414 of the Indian Penal Code and Sections 30(a), (b)(c)(f), 38 and 41 of the Bihar Prohibition and Excise Act.
Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Further submission is that similarly situated co-accused person has been granted bail by a co-ordinate Bench of this Court in Crl. Misc. No. 66687 of 2019
Patna High Court CR. MISC. No.70315 of 2019(2) dt.06-11-2019 2/2 vide order dated 21.10.2019. The petitioners have no criminal antecedent and in custody since 11.08.2019.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge Excise Act, Sitamarhi in connection with Mahindwara P.S. Case No. 107 of 2019.
