2. The petitioner apprehends arrest in connection with Baghaila P.S. Case No. 108 of 2025 dated 09.07.2025, registered for the offence punishable under Sections 191(2), 191(3), 127(2), 115(2), 117(2), 118(1), 109, 303(2), 74, 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that the petitioner along with other co-accused persons is said to have assaulted the informant by means of lathi, danda and iron rod. The allegation against the petitioner is that he assaulted by means of iron rod on the head of the informant causing head injury with an intention to kill him.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that the allegation against the petitioner is that he assaulted the informant by means of iron rod on the head due to which he sustained head injury. From perusal of the impugned order, it appears that the nature of injury is said to be simple in nature. It is submitted that both the parties are agnates and there is case and counter case between the parties. Counter case bearing Baghaila P.S. Case No. 110 of 2025 has been lodged by one Sunil Paswan against the informant and his family members. Lastly, it has been submitted that he has no criminal antecedent.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Baghaila P.S. Case No. 108 of 2025, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.69064 of 2025(2) dt.24-09-2025 3/3 (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sasaram (Rohtas), subject to condition as laid down under Section 482(2) of B.N.S.S..
