The petitioner, who is in custody, seeks bail in connection with Excise Case No. 756 of 2018 (arising out of Jehanabad P.S. Case No. 592 of 2018) registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Allegation against petitioner is of recovery of 21 litres 375 ml. Royal Stag English Wine from the rented house of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case on merely suspicion. Petitioner has not taken the room in the house of

Patna High Court Cr.Misc. No.55134 of 2018(2) dt.05-10-2018 2/2 Asha Devi and he has no concerned with the alleged business of the illegal wine. As per FIR and seizure list, the alleged wine has been recovered from the house of Asha Devi. Nothing has been recovered from conscious possession of the petitioner. Petitioner has no criminal antecedent and he is in custody since 27.07.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Jehanabad, in connection with Excise Case No. 756 of 2018 (arising out of Jehanabad P.S. Case No. 592 of 2018).
