2. Petitioner apprehends arrest in a case registered for the offence punishable under section 21(b) of the NDPS Act.
3. As per the prosecution story, the police, upon information that in the garb of medicines, drugs are being sold by Roz Medical, conducted a raid, and one Ramchandra Yadav was apprehended on the spot with one bottle of codeine cough syrup, who disclosed that the same was purchased from the shop of the petitioner, upon which a raid was conducted at the shop of the
Patna High Court CR. MISC. No.73033 of 2023(3) dt.29-02-2024 2/3 petitioner and some bottles of prohibited codeinecontaining cough syrup were found in huge quantities in the shop of the petitioner.
4. It is submitted that the petitioner has been falsely implicated in this case only on the basis of suspicion. The petitioner is not the owner of the alleged medical hall. The owner of the alleged medical hall is the father of the petitioner, namely the late Ishlamuddin. No incriminating material has been recovered from the conscious possession of the petitioner. He has been made accused in this case merely because he is the son of the owner of the medical hall. The petitioner was neither apprehended on the spot nor he is in any way connected with the alleged occurrence.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail

No.73033 of 2023(3) dt.29-02-2024 3/3 bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge Araria in connection with Special NDPS Case No. 41 of 2021 arising out of Forbesganj P.S. case No. 973 of 2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
