The petitioners apprehends their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 325, 307 and 379 of the Indian Penal Code. 3.

From perusal of the case diary, it appears that petitioner nos.1, 3 and 4 have suppressed their criminal antecedents. Petitioner no.1 has four criminal antecedents but in para-3 of the bail application it has been stated that petitioner no.1 has two criminal antecedents. Petitioner no.3 has one criminal antecedent but in para-3 it has been mentioned that he has no

Patna High Court CR. MISC. No.72329 of 2024(3) dt.14-02-2025 2/3 criminal antecedent. Similarly, petitioner no.4 has also three criminal antecedents but in para-3 it has been mentioned that he has only one criminal antecedent.

Considering this fact that the petitioner nos.1, 3 and 4 have suppressed their criminal antecedents, I am not inclined to entertain their bail applications. The prayer for bail on their behalf stands rejected.

Now, this case is being heard only with regard to the petitioner no.2.

The allegation against the petitioner is that he and other co-accused persons assaulted the informant's side by means of several weapons due to which they sustained injuries. It is also alleged that a golden locket and Rs.11,000/- was also snatched from the informant.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is case and counter-case between the parties. There is no specific overt act against the petitioner. Petitioner no.2 has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, since there is no specific allegation against the petitioner no.2, let the above named petitioner no.2, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Ghoshi P.S. Case No.274 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. 10.
