====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-10-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are in custody in connection with Yogapatti P.S. Case No. 88 of 2019 for the offences under Section 30(a) of Bihar Prohibition & Excise Act, 2016. Learned counsel for the petitioners would submit that the petitioners have no criminal antecedent. In the instant case total 62 ltrs of liquor was recovered from the possession of the petitioners. The petitioners are in custody since 03.07.2019. Considering the fact that the petitioners have no criminal antecedent, the Court is inclined to grant bail to the petitioners subject to cash deposit of Rs. 25,000/- (Twenty Five

Patna High Court CR. MISC. No.63334 of 2019(2) dt.17-10-2019 2/2 thousand) each in the Court below and on deposit of the same, the Court below shall release the petitioners, above named, on bail on furnishing bail bonds of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Bettiah, West Champaran, in connection with Yogapatti P.S. Case No. 88 of 2019.

The cash deposit of Rs. 25,000/- shall abide by the final outcome of the pending criminal case.
